Hello,

sorry for writing in English - I can read Romanian, but cannot write it. Two points:

  • The image is mirror-inverse, see for example the Stefan-Jäger-Website. The Swabians moved from west to east :-)
  • But what is more important: The image is copyrighted until the year 2032 - I am sure that http://www.dvhh.org/ does not hold the copyrights on the image, so they cannot give it to Wikipedia. Furthermore "non-commercial reproduction"-only also violates the Wikipedia image guidelines.

Please remove the image. Thank you. --Swabian 17 aprilie 2007 13:12 (EEST)[răspunde]

I'm afraid your word only does not suffice to delete the image. You will have to provide evidence that the DVHH does not hold the copyright on the image. They expressly granted it to Wikipedia and we have uploaded it in good faith. Whether that was not the case, you will have to take it with DVHH and if there was a copyright infringment by them, and they properly react on the issue, we will delete it without any problem. Also, if you can provide direct evidence that the image is indeed copyrighted until 2032 and that DVHH is not holding any copyright for it, then we can delete it without further notice. Thank you--—Radufan 17 aprilie 2007 13:29 (EEST)[răspunde]
Come on, Radu, are you either naive or stubborn or both? You asked a webmaster of an US organisation which uses the image under fair-use-terms. Of course they ".. see no problems on the part of the DVHH administrative team with your non-commercial reproduction of the Jäger painting" - but they do not say explicitly that they own the copyright. It's just a site using a picture, you know? According to EU regulations the copyright expires 70 years after the year of death of the painter, so you need the permission of the person who owns the copyright, like his children, etc. It is up to you to find out who this is before you take a finding of the web, put it in the wikipedia and say "use it cu orice scop".
My proposal: Try to upload it on commons and see if it will stay there. Then you win. Otherwise I win. --Swabian 17 aprilie 2007 15:52 (EEST)[răspunde]
